The impact of void adjudications

The Supreme Court of Queensland has held that a void adjudication does not extinguish a party’s right to make a payment claim in respect of the same issues and to have that payment claim adjudicated. The court also confirmed that, as in NSW in Dualcorp Pty Ltd v Remo Constructions Pty Ltd [2009] NSWCA 69; The University of Sydney v Cadence Australia Pty Ltd [2009] NSWSC 635, once an adjudication has occurred there can be no re agitation of the same issues.
